TERMS OF USE

1.1  The following clauses constitute the terms of use subject to which individuals (the “users”) may access the areas of the Criminal Law Week website (www.criminal-law.co.uk) (the “website”) which are not log-in protected (the “open access pages”).

1.2  Supplier means Thomson Reuters (Legal) Limited trading as Criminal Law Week.  “Criminal Law Week” is a trade name of Supplier; all rights in the trade name are reserved.

Copyright, etc.

2.1.       Excepting rights of third parties in the contents and design of any third party advertisements, logos, trademarks or other materials and excepting any parliamentary or crown copyright material reproduced with the permission of the Controller of HMSO and the Queen’s Printer for Scotland, the contents and design of the open access pages are copyright of Supplier and all other rights, title, interest and intellectual property rights in the open access pages belong to Supplier.

2.2.       Use of the open access pages or of any material contained therein in any way that infringes the copyright or other proprietary interests therein, including by removing or obscuring any copyright notices or other notices contained in the open access pages, or by reproducing or using the Criminal Law Week trade name, is unauthorised.

Use of Criminal Law Week open access pages

3.1.       Excepting as permitted below, no part of the open access pages or the contents and design of the open access pages may be used, reproduced, photocopied, modified, printed, sold, transferred, displayed, transmitted, republished, or in any other way exploited, in any form, including distribution, storage in an electronic system for retrieval, transient reproduction by means of a computer system or network, or by creating derivative works from the services.  

3.2.       Permission is granted to users to use the open access pages in accordance with these terms of use by electronically displaying the open access pages on a computer screen, printing or photocopying individual articles or pages and retrieving and storing machine-readable copies (including the caching of pages for users’ browser software which are copies of the then current open access pages only for the user’s personal use).

3.3.       No use, reproduction, photocopying, printing, display, or storage of any part of the open access pages of this website is permitted by the foregoing permission for purposes outside the permission, such as printing or photocopying for general circulation.

3.4.       Subject to acknowledging the source of the information by referencing “Criminal Law Week” with the title of the article or the Unique Resource Locator of the open access page, it is permissible to quote from the open access pages in printed or broadcast news media, professional journals or promotional literature distributed free of charge, but this shall not extend to reproducing the whole or a substantial part of any page.

3.5.       It is permissible to create links to the open access pages provided that no charge is made to access such links and that Supplier is acknowledged as the source of such links.   Supplier reserves the right to withdraw this permission at any time with immediate effect and accepts no obligation to maintain such links current.

Online Access and Usernames and Passwords

4.         Unauthorised access to the pages of this website which are not open access pages is a criminal offence, contrary to the Computer Misuse Act 1990.   Access to the pages of this website which are not open access pages by users who do not fall within one of the following categories is unauthorised.

  1. Individual subscribers - i.e. individuals having their own personal online or combined subscription to Supplier and to whom a username and password have been issued by Supplier.
  2. Nominated individuals within a firm, set of chambers or organisation.   Where a firm, set of chambers or organisation has an online or combined subscription, only the individual in whose name the subscription has been set up is authorised to access the pages of this website which are not open access pages.   The disclosure of a username and password to other individuals in the same firm, set of chambers or organisation is strictly forbidden.   The foregoing is subject to alternative arrangements being agreed in individual cases (in which case extra users will have their own usernames and passwords).
  3. All members of an academic institution authorised by that institution to use the username and password issued to that institution by Supplier. 
  4. Individuals with their own username and password in a firm of solicitors that subscribes to Criminal Law Week Plus.
  5. Barristers in a set of chambers or persons in other organisations that have a Criminal Law Week Group Online subscription with Supplier and to whom individual usernames and passwords have been issued.
  6. Individuals who currently have a free trial.
  7. Individuals who have been issued with an eLIS password by the MOJ;  but - in the case of part-time judges, authorised access is restricted to those periods when the individual in question is performing judicial functions and the access is for the purpose of those judicial functions.    Access by part-time judges using their eLIS access details when they are not exercising judicial functions or for purposes other than the performance of those functions is strictly prohibited.
  8. All employees of the Crown Prosecution Service.
  9. Subscribers to the Police National Legal Database who are entitled to access the Police National Legal Database via the CJX intranet.

Changes to these terms of use

5.         Supplier may, in its discretion, change these terms of use without notification, by posting new terms of use on the open access pages.   Use of the website following the posting of a new set of terms of use will constitute an acceptance of the terms of use as modified.

No Warranty, Disclaimer of Liability

6.1.       Whilst every effort has been made to ensure the high quality and accuracy of the open access pages and the materials contained therein, Supplier makes no warranty, express or implied, concerning them and they are provided "as is".   Supplier expressly disclaims all warranties, including but not limited to warranties of fitness for a particular purpose and warranties of merchantability.   In no event will Supplier be liable for direct, special, incidental, or consequential damages (including, without limitation, damages for loss of business profits, business interruption, loss of business information or other pecuniary loss) arising directly or indirectly from the use of or reliance on the open access pages and the materials contained therein, even where Supplier has been advised of the possibility that such damages may arise.   The open access pages and the materials contained therein are provided for information only and are not offered as an exhaustive statement of the law.   Commentary is offered as opinion, and not as professional legal advice.

6.2. Supplier is not liable for the content and design of any third party materials included in the open access pages (excepting any rights, including intellectual property rights, of Supplier in such materials).

Severability/ Survival

7.         If any provision of these terms of use is invalid or unenforceable, such invalidity or unenforceability will not render all the terms and conditions unenforceable or invalid but rather the terms of use will be read and construed as if any invalid or unenforceable provisions were not contained therein.

Non-waiver

8.         No delay or omission on the part of Supplier in enforcing any provision of these terms of use will operate as a waiver of any right.

Governing law

9.         These terms and conditions shall be governed by and construed in all respects in accordance with English law and the parties agree to submit to the non-exclusive jurisdiction of the English courts as regards any claim or matter arising in relation to these terms of use.
